Terms of Use
Draft — for review by a licensed attorney before publishing. This is review-ready draft copy prepared by the Astoundz team. It is not legal advice and is not final. Several clauses that shape real liability — the warranty disclaimer, the limitation of liability, and the indemnity — are intentionally left for a Texas-licensed attorney to draft. Every [PLACEHOLDER] below must be filled in, and an attorney must review the whole page, before it is treated as complete or goes live.
Last updated: [PLACEHOLDER: date to be set on the day this is approved and published]
Welcome. These are the terms for using thelovefaery.com and for working with Tatiana. We've written them in plain language on purpose. Using this site means you're okay with them.
Who we are
This site belongs to Tatiana Schallert, doing business as The Love Faery, in Texas. [PLACEHOLDER: Tatiana/Caleb to confirm the final contracting entity — sole proprietor today, single-member LLC pending; if the LLC forms, it becomes the party named here.]
What we offer, and what it is not
Please read this part carefully. The Love Faery offers artistic, educational and spiritual experiences. Tatiana Schallert is a musician, voice coach and gathering facilitator. She is not a physician, psychologist, licensed counselor, therapist, dietitian or other licensed healthcare provider, and nothing offered here is medical care, mental-health treatment, diagnosis, or a substitute for either. Voice coaching, sound baths, and sacred gatherings are offered as wellness, artistic and educational experiences only — they are not intended to diagnose, treat, cure or prevent any disease or condition, physical or mental. If you are experiencing a medical or mental-health concern, please consult a licensed professional. If you are in crisis, call or text 988.
That disclaimer matters, so it also appears in the footer of every page and on every service page. It isn't a formality — it's what's true.
Voice coaching
Sessions are booked one at a time or in packages, by arrangement. Coaching is a teaching relationship, not a promise of any particular result — every voice and every learner is different. Rates and formats are listed on the voice coaching page. [PLACEHOLDER: Tatiana to provide real rates and in-person/online format; do not publish an invented number.]
If you need to move or cancel a session, please give us reasonable advance notice and we'll reschedule at no cost. [PLACEHOLDER: confirm the exact notice window — e.g. 24 hours — and the policy for late cancellations and no-shows.]
If the first session isn't the right fit, tell us and we'll talk about making it right. [PLACEHOLDER: Tatiana to approve the first-session refund commitment and attorney to approve the wording — proposed: notify within 24 hours for a full refund of the first session.]
Gatherings and sound baths
Gatherings and sound baths are ticketed or RSVP events at various locations. They are offered as experiences of music, rest, stillness and community — not as therapy or treatment (see the disclaimer above). Dates go out to the Faery Circle first. [PLACEHOLDER: confirm an age policy for gatherings — proposed 18 and older; if minors are ever admitted, that needs its own legal review before it is advertised.]
Retreats
Right now, retreats are waitlist only. No seat is reserved, and no money is owed, until dates are announced and you complete registration in writing.
When registration opens, the full Retreat Terms and Cancellation Policy and a Participant Waiver will be published on the retreat page. You'll read them and agree to them before any payment is taken — not after. Those documents will spell out:
- the total price, and exactly what is and isn't included;
- the deposit and the balance, with dates; [PLACEHOLDER: deposit amount and due date.]
- the refund schedule in plain days; [PLACEHOLDER: refund schedule — e.g. full refund through a stated date, partial through a stated date, non-refundable after.]
- whether and how a seat transfers to another guest; [PLACEHOLDER: seat-transfer policy.]
- what happens if we cancel — our recommendation is a full refund, plainly stated; [PLACEHOLDER: organizer-cancellation refund policy, pending sign-off.]
- weather and circumstances outside anyone's control.
Until those documents are live, nothing on this site is an offer to sell a retreat seat, and the waitlist is not a reservation.
Payments and refunds
We are not selling anything through this website yet. When online payment is added, the price, what it includes, and the refund and cancellation terms for that specific offering will be shown to you before you pay — never after — and you'll confirm you've read them at checkout. [PLACEHOLDER: name the payment processor and the on-site checkout terms once online selling is enabled.]
Music, words and the name
The songs, recordings, writing, photographs, artwork and design on this site belong to Tatiana Schallert. Please enjoy them, share links to them, and quote a line with credit. Please don't copy, re-record, sell or use them commercially without written permission.
The Love Faery™ is a common-law trademark of Tatiana Schallert. It is not currently a federally registered mark. [PLACEHOLDER: confirm the first-use-in-commerce date — 2018 or 2019 — before this page states a 'used in commerce since ___' date; USPTO clearance and any registration decision are pending attorney review.]
Streaming links point to official platform pages. Those platforms have their own terms.
What you send us
If you send us a message, a photo, a recording or a story, you keep it. You're giving us permission to read it and reply. We won't publish anything you send — a quote, a photo, a review, a song — without asking you first, in writing.
Our intended policy is that a song written by a guest at a retreat belongs to that guest. [PLACEHOLDER: attorney to finalize the retreat-song ownership language — proposed: the guest owns their song outright, Tatiana claims no authorship or royalty, with a separate opt-in if she'd like to share an excerpt for promotion.]
Links to other places
We link to Spotify, Bandcamp, and other sites we don't run. What happens there is between you and them.
The legal necessities
A full warranty disclaimer, limitation of liability, and indemnity section belongs here. These clauses shape real liability and are not something we template — they must be drafted by a licensed Texas attorney. [PLACEHOLDER: attorney to draft the warranty disclaimer, limitation of liability, and indemnity clauses. This page is not complete without them.]
Where disputes go
These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Any dispute goes to the state or federal courts of the Texas county where the business operates. [PLACEHOLDER: confirm the exact venue county — proposed Harris County; confirm against the actual county of residence/operation, since Cypress straddles Harris and Waller.]
[PLACEHOLDER: attorney's call — whether to add an arbitration clause and class-action waiver, and if so, with what opt-out.]
Changes
If these terms change, the date at the top changes with them.
How to reach us
[PLACEHOLDER: Tatiana/Caleb to provide a published contact email and a P.O. Box mailing address, City, TX, ZIP.] In the meantime, use the contact page.
